Tahawwur sun: 26/11 An important legal question emerges after Tawwur Hussain Rana was extradited to India in the case of Mumbai terror attack from America, why is Rana being prosecuted again, while he has already been sentenced in America? The answer to this question is hidden in the basic margin between the allegations made against him in the US and the allegations against him in India.

Pakistan -born Canadian citizen and former Pakistani Army doctor Tawwur Hussain Rana was arrested in the US in 2009. In 2011, an American court convicted him for assisting Lashkar-e-Taiba (Let) and joining a failed terrorist conspiracy in Denmark. But during this time he was acquitted of allegations of directly involved in the Mumbai attacks. He spent 14 years in the US jail and was released on health basis during the Covid-19 epidemic in 2020.

However, India made a completely different and more comprehensive case against him, which was directly focused on the 26/11 Mumbai attacks. More than 170 people were killed in this attack. Due to a separate case, India got great success in extradition of Tehwavur Rana. In the US, Tawwur Rana was accused of supporting terrorism. In the Mumbai case, he was acquitted of allegations.

Rana was convicted in these cases in America

  1. Providing Material Support to Pakistan-based terrorist organization Lashkar-e-Taiba behind the Mumbai attacks.
  2. Promoting terrorist conspiracy in Denmark, failed conspiracy to attack the Galends-Posten newspaper when published controversial cartoon in Copenhagen.
  3. Supporting David Coleman Headley, who was his childhood friend and the main detective of the Mumbai attacks. Accused of allowing Headley to use his Immigration Business for travel and reconnaissance missions.

The allegations were associated with the misuse of Tawwur Rana Immigration firm “First World Immigration Services”, through which he provided fake documents and cover to Headley. However, US prosecutors did not make any special allegations against Rana about the Mumbai attack. The court accepted his ideological inclination and connection but did not find enough evidence for his direct participation in the 26/11 planning.

India made serious allegations against Rana like criminal conspiracy and waging war. The result of serious allegations against Rana was that the US agencies took cognizance of it.

NIA accused Rana this

  1. In the Mumbai attacks, the terrorists provided every facility to the terrorists so that they could succeed in their cause.
  2. Rana was accused of criminal conspiracy under the Indian Penal Code.
  3. Warning against India is a serious offense under Indian law.
  4. Helping and promoting murder and terrorism based on their alleged coordination with Headley and Lashkar during several trips to India.
  5. Assistance in target monitoring for 26/11 attacks, including Taj Hotel and Chhatrapati Shivaji Maharaj Terminus in places like Tarohi Missions.

Intelligence reports quoted by Indian authorities claimed that Rana was in touch with Headley at least 231 times before the attacks and helped in eight separate monitoring operations.

Legal argument

Rana’s legal team opposed his extradition, arguing that the same evidence was being used to prosecute him again. However, the US courts rejected the argument. He agreed with India’s claim that the two cases were legally different, including different allegations, jurisdiction and facts.

The US court ruled that the 26/11 Mumbai attack is quite large. On April 4, 2025, the American Supreme Court rejected Rana’s final appeal, clearing the way for his extradition. This reflects a strategic difference in how the two countries make cases of terrorism. The US focused on punishment for preventing future attacks and providing logistics aid, while India’s goal was to prosecute Tehwavur Rana, Headley and other accused to be fully prosecuted for a conspiracy in the case.

In addition, this extradition indicates a diplomatic victory for India and confirms international cooperation against terrorism. The interrogation of Rana is expected to reveal the role of Pakistan’s intelligence agency ISI) and Lashkar’s operatives, which can lead to possible new clues in a long -standing investigation.
